Formalise project approvals and announcements

How to implement this Standard

Key elements

  • The project approvals process should be co-designed by the Prescribed Body Corporate (PBC) and the Proponent and include formal sign-off by all signatories.
  • Throughout the project life cycle, the timing and method of consent timeframes and signoffs must be culturally appropriate and reflect decision-making processes that abide by the traditional Lore and customs of an affected native title group.
  • Formal sign-off of agreements must include the obligation to hold a community meeting (unless otherwise not required by the PBC) with the specific intention of gathering all signatories from the PBC and the Proponent. This is a vitally important communication opportunity to keep the community informed about the project’s progress and to evidence the genuine partnership between parties.
  • Rules should be set regarding public announcements about the project. Premature media announcements that have not been consulted on can place unreasonable pressure on the PBC regarding consent to project approvals, and is contrary to the principles of free, prior, and informed consent (FPIC) – particularly the requirement that there be no coercion, intimidation or manipulation. Media announcements should be provided to all parties well before release.
  • Documentation must be prepared in accordance with commercially accepted practice, including engagement of appropriate legal and other experts.
