Under the Native Title Act (1993) (NTA), notification must be given before any proposed activity can be undertaken on traditional lands and waters that may affect native title and interests. This includes but not limited to, prospecting, exploration, mining, fishing, tourism or other proposed developments.
One of YMAC’s functions as a Native Title Representative Body under the NTA is to ensure that notices that relate to land or waters within the area for which the YMAC is the representative body are brought to the attention of any person that the YMAC is aware of who holds, or may hold, native title. The notices relate mainly to future act and other notices which governments and corporations are required to issue for proposed acts which may impact native title.
If you represent a company seeking to identify and/or notify Traditional Owners of proposed works/activity on land and sea Country within YMAC’s representative area, please email ntrb@ymac.org. Our team will then identify which Traditional Owner/s are affected by the notice (e.g. Registered Native Title Body Corporate’s (RNTBC/s), native title claimant/s) and take appropriate action to notify the relevant people, in accordance with YMAC’s notification procedures.
