Development approvals

Development approval is a significant project asset – without it a Renewable Energy Developer (RED) won’t want to move forward.

Development approvals will vary for each project and will have been identified in the Pre-feasibility, Feasibility and/or Design and engineering stages. It’s often concurrent with stages 8 and 9, although final approval will be conditional upon grant of tenure and execution of the Indigenous Land Use Agreement (ILUA)/Head Agreement.

Development approvals

Once achieved, development approval is a significant project asset. The aim is to achieve development approval to a level of business certainty that is less likely to be challenged in the future. They have a time limit – generally construction must be substantially commenced within a set timeframe. Development approvals will be progressed more rapidly where the Prescribed Body Corporate (PBC) is fully supportive of the project. Activity associated with any decisions made based on changes which have not been previously agreed cannot progress in any way without free, prior, and informed consent (FPIC).
Specific experts and consultants will be appointed by PBCs when necessary, funded by REDs. Development approvals required may include local, State and Commonwealth government compliance including, but not limited to, applications under the:
  • Environment Protection and Biodiversity Conservation Act 1999 (Cth);
  • Planning and Development Act 2005 (WA);
  • Environmental Protection Act 1986 (WA); and
  • applicable Local Planning Scheme.
Processes and outcomes must be documented along with regular review at agreed intervals, particularly when new information comes to light. Sharing this with PBCs, in a timely manner, is an effective way to achieve FPIC at every stage throughout the process and keep the project on track.

Communications and announcements

Communication and announcement opportunities arise in this stage and must be jointly managed with full consultation and agreement, e.g., media announcement, newsletter to Common Law Holders. Failure to do so may be perceived as coercion, intimidation or manipulation and undermine FPIC.

YMAC’s Renewable Energy Guide has been developed for use by Prescribed Bodies Corporate (PBCs), Traditional Owners, Renewable Energy Developers (REDs), government and industry.

It is designed as a ‘big picture’ framework for renewable energy projects. Its intention is to support a best practice approach by all parties involved in a project. 

All projects are different, and the Project Timeline is not intended to be a perfect fit for all projects. That is, for any project, stages may occur or commence at different times or not be required. Some stages are linear, and others may occur, in whole or in part, concurrently. Each stage incorporates considerations for other stages, as relevant to a project.
